ShedShare Community Disclaimer & Liability Waiver 1. WHAT SHEDSHARE IS ShedShare is a platform that connects neighbours who want to lend, hire, or borrow tools. That is all we do. We are not a party to any agreement you make with another user. We do not own, hire out, store, handle, inspect, test, service, certify, or insure any tool listed on ShedShare, and we do not check any user's identity, licence, qualifications, competence, or suitability. 2. WE ACCEPT NO RESPONSIBILITY FOR ANY INJURY OR DAMAGE To the fullest extent permitted by law, ShedShare — including its owners, directors, staff, and contractors — accepts no responsibility and no liability of any kind for any injury, illness, death, property damage, theft, loss, non-return, financial loss, or legal claim arising out of or connected with: • any tool listed or arranged through ShedShare; • any accident, malfunction, defect, or misuse of a tool; • the acts, omissions, or conduct of any other user; • the pickup, delivery, transport, use, storage, or return of any tool. This applies whoever is harmed — a renter, an owner, a family member, a bystander, or any other person. Any claim you have is against the other user directly, and not against ShedShare. 3. WE DO NOT PROVIDE INSURANCE ShedShare does not provide, arrange, or sell insurance of any kind. Using ShedShare does not give you any insurance cover for injury, damage, loss, or theft, and it does not extend or replace any policy you hold. Arranging your own insurance is your responsibility. If you own a tool, check whether your home and contents or landlord policy covers tools you lend to other people — many policies do not, or limit that cover — and look into separate cover if it does not. Never assume a tool is insured. 4. ASSUMPTION OF RISK Lending, hiring, and using tools — especially power tools, construction equipment, and machinery — carries inherent risk, including serious injury and death. By using ShedShare you voluntarily accept all of those risks. You are responsible for deciding whether a tool, and the person you are dealing with, is safe and suitable for you. 5. YOUR RESPONSIBILITIES You are solely responsible for: • inspecting a tool and confirming it is safe, complete, and in working order before you take it or hand it over; • using and maintaining tools properly, and following the manufacturer's instructions and all safety requirements; • making sure you are legally allowed to lend or hire the tool, and that you hold any licence, ticket, or qualification needed to use it; • arranging your own insurance; • agreeing pickup, use, and return directly with the other user; • resolving any dispute directly with the other user. 6. DEPOSITS ARE NOT INSURANCE Security deposits are held only to cover loss of, or damage to, a tool. They are not insurance, and they do not cover injury, illness, death, or damage to any person or to third-party property. 7. NO WARRANTIES ShedShare is provided "as is". We give no warranty and make no promise about the platform, any tool, any user, or the outcome of any arrangement made through ShedShare. 8. INDEMNITY You agree to indemnify and hold ShedShare harmless against any claim, loss, damage, or expense arising from your use of ShedShare, your dealings with another user, or your breach of this waiver. 9. YOUR LEGAL RIGHTS Nothing in this waiver excludes, restricts, or modifies any right, guarantee, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. 10. SEVERABILITY If any part of this waiver is found to be unenforceable, the remaining parts stay in full effect. By creating an account you confirm that you have read, understood, and accepted this waiver, and that you are at least 18 years old.
